USER TERMS AND CONDITIONS

ALS Limo & Car Service

Billing 

Rides are billed to the customer’s credit card or corporate account numbers. ALS accepts the following cards:
American Express
Diners Club
Discover Card
MasterCard
Visa

  • ALS  drivers do not accept gratuities. A 20% service fee that is calculated on the base fare, stop time, wait time, and any holiday surcharges will be added and itemized on the customer’s billing statement.
  • The following additional charges will be itemized on the customer’s billing statement when applicable:
    Two-way tolls
    Airport and Regulatory Fees
    Fuel Surcharge
    Cell Phone
  • Certain trips may require an additional fee for meals and/or overnight accommodations for the driver.
  • Applicable taxes will be charged as required.
  • All published rates are subject to change without notice. Current rates are confirmed at the time a reservation is made.
  • All rates are calculated in the local currency and billed in U.S. dollars at the prevailing exchange rate.
  • Due to fluctuation in currency exchange rates, all US dollar equivalents of international rates may vary.

 

Individual Reservations

Individual Cancellations for Airport services must be made 7 days prior to the service date for a refund. Cancellations less than 7 days will be billed 100% of total fare. Cancellations for Hourly services must be made 14 days prior to the service date for a refund. Cancellations less than 14 days will be billed 100% of total fare.

Group Reservations

Group Cancellations for conventions/multiple group reservations must be made 14 days prior to the service date. Cancellations less than 14 days will be billed at 100% of total fare. No shows are billed at 100% of total fare. (for Organizations that seek multiple reservations for conventions, trade shows, travel agent, event coordinators, and all other multiple reservations.)

Prom Cancellation Policy

Sedan Rates

  • ALS  has standardized point-to-point rates that provide flat rate pricing for travel to and from most major cities and airports.
  • Sedan rates for travel between locations in which a point-to-point rate does not exist will be billed at the prevailing ALS   hourly rate. Customers are billed from the time the vehicle leaves the ALS  Services  facility until the time it returns to the ALS  Services facility, with 1.5 hour minimum.
  • All Reservations that are billed on an hourly basis, will be billed a minimum of thirty minutes travel time each way plus the time the passenger is in the vehicle.
  • Fractions of an hour are rounded to next half-hour.

 

Wait Time / Stop Time

  • For all point-to-point reservations, wait time will be charged at $7.00 per five (5) minute increment once the ALS  Services grace period has elapsed. ALS  Services grace period is defined as five (5) minutes beyond the scheduled pick up time.
  • ALS  is able to monitor all commercial flights, therefore, wait time is not charged for any passenger arriving on a commercial airline.
  • ALS  does not monitor private flights, therefore, wait time will be charged as incurred for any passenger arriving on a private plane that is delayed by more than 5 minutes.
  • ALS  does not monitor train schedules, therefore, wait time will be charged as incurred for any passenger arriving by train that is delayed by more than 5 minutes.
  • Passenger requested stops on route during a point-to-point reservation will be charged at $7.00 per five (5) minute increment.
  • Passenger requested stops off route for point-to-point reservations, charges will revert to the prevailing ALS  hourly rate.

 

Cancellation and No Show Fees

  • Cancellation and No Show Fees All airport transfers must be canceled 7 days in advance for a refund. All limousines and other charter services must be canceled 14 days prior to service date for a refund. No shows are billed at 100% of contract price

 

Holidays

  • A 25% U.S. holiday surcharge, based on the fare, stop and waiting time, will be charged to all trips occurring on:
    New Year’s Day
    Memorial Day
    Fourth of July
    Labor Day
    Thanksgiving Day
    Christmas Day
  • Holiday surcharges also apply to additional holidays in locations outside of the United States.

 

Events Services (Limousines, Vans, Minibuses, Motorcoaches)

  • All Event Services vehicle types will be billed at the prevailing ALS  hourly rate.
  • Customers are billed from the time personnel and/or vehicles leave the ALS  facility until the time it returns to the ALS  facility.
  • All Reservations that are billed on an hourly basis, will be billed a minimum of thirty minutes travel time each way plus the time the passenger is in the vehicle.
  • Fractions of an hour are rounded to next half-hour.

 

City-To-City Fares

  • Roundtrips include up to four hours of wait time and must be completed within the same calendar day.
  • Wait time over four hours will be charged at the prevailing ALS  hourly rate.

 

Prom Limousine Services

  • CANCELLATION POLICY FOR PROM RESERVATIONS: All Prom Reservations are subject to the following terms of service A 40% NONE REFUNDABLE deposit may be charged immediately once your reservation is secured. Any cancellation is subject to the 40% none refundable penalty. Cancellations less than 30 days are subject to 100% penalty.
  • All clients 16 and over are authorized to secure reservations by phone. Minors under 16 must have permission of a parent or legal guardian to secure reservations.

 

Flat Daily Rates

  • All flat daily rates are subject to a 8-10 hour minimum, depending on the type of vehicle. Additional time will be billed in an hourly basis at the prevailing hourly rate for the particular vehicle. Services over a certain number of hours will require an additional driver and will be billed accordingly.For services over a certain number of hours which may require driver to spend the night outside of his residence room and board charges will be added to total.

 

Other

  • ALS  shall not be liable for circumstances beyond its control including but not limited to weather, road conditions and breakdowns.
  • ALS  assumes no responsibility for lost or damaged baggage, personal belongings, or any items left in the vehicle.

 

Baggage and Other Property Transported

Our company does not assume any responsibility whatsoever for the handling or maintenance of any baggage, parcels or other property. Baggage and all other personal property will be handled only at Client’s own risk. Client’s baggage shall be carried subject to the available accommodations.

Objectionable Persons

ALS  Services reserves the right to refuse to transport persons under the influence of intoxication liquor or drugs, or who are, or are likely to become objectionable to other persons or if the Chauffeur feels threatened in any way.

Conduct of Passengers

Client shall not interfere with the Chauffeur in the discharge of his/her duty or tamper with any apparatus or appliance on the vehicle.

Prohibition of Weapons, Explosives, Oxygen, Pets, Livestock And Other Dangerous Or Unusual Cargo

Weapons of any type, including firearms, are strictly forbidden on any Equipment (whether in baggage or on the person) at any time. Transportation of explosives, fireworks and other flammable, combustible, toxic or otherwise dangerous material or items or pets or livestock of any kind are also strictly forbidden, even if intended to be transported in the baggage compartment of the vehicle. If previously approved by the Company, oxygen for medical use is permitted, but is so used at the sole responsibility of the Client.

Unusual Cleaning

If, during or after the transportation service, our Company is required to expend a greater than normal amount of time and material clean the vehicle due to acts of the Client, the Company, at its option, may charge Client additional fees to cover such additional time and materials.

Limitation of Liability

ALS  Services SHALL NOT BE LIABLE IN ANY EVENT OR FOR ANY REASON, INCLUDING BREACH OF THIS AGREEMENT, EITHER DIRECTLY OR INDIRECTLY, TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS ARISING OUT OF THIS AGREEMENT, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.IT IS EXPRESSLY AGREED THAT THE COMPANY SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO ANY PARTY FOR AN AMOUNT GREATER THAN THE SINGLE FARE FEE FOR THE DAY IN QUESTION.

Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under the Service Contract, and the Company shall not be deemed in breach of its obligations thereunder, if such failure or delay is due to Acts of God, natural disasters, national, state or local states of emergency, acts of war or terrorism, labor strike or lock-out, or other industrial or transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of the Company.

ADA/SPAB Notice

Any group that requires an ADA accessible or SPAB Certified bus and driver is requested to inform the Company in writing at the time of the reservation.

Entire Agreement

These Policy and Terms, along with the Application for Corporate Credit and the Terms and Conditions listed on the Company’s web-site, constitute the Service Contract which is the entire agreement between the Company and Client and supersedes any and all other agreements, either oral or written with respect to the subject matter hereof. If any provision of the Service Contract shall be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

This Agreement and its performance shall be governed by the laws of the State of California, United States of America without giving effect to applicable conflict of law provisions.
Arbitration – In the event a dispute shall arise between the parties to this agreement it hereby agreed that the dispute shall be referred to the American Arbitration Association for three-person arbitration in accordance with its applicable Rules of Arbitration. The arbitrators’ decision shall be final and legally binding and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrators’ award or fails to comply with the arbitrators’ award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.
Termination – If Client does not conform to the conditions stated in the Service Contract, the contract with Client will be terminated with immediate effect without warning or written notice, and the payment made will be retained by the company.
Authorization

No agent, employee or representative of the Company is authorized to alter, modify or waive requirements stated in the conditions of transportation or service.
